EU Data Act
The EU Data Act (Regulation (EU) 2023/2854) regulates fair access to and use of data generated by connected products and related services. The aim of the regulation is to give users greater transparency and control over their data.
In connection with the use of our smart lighting system smik, this means:
- Users receive clear information about which data is generated through the use of smik and for what purposes it is processed.
- Users have the right to export or receive their usage data.
- Data is only passed on to third parties on the basis of explicit consent or legal requirements.
An information document on smik usage data and the corresponding transparency obligations in accordance with the EU Data Act is available as a PDF on our Gateway product page. In addition, the smik Terms of Use contain a data licence agreement with provisions on data use and disclosure. For personal data, our smik Privacy Policy also applies.
Our Zigbee products include the categories lamps & lights, smart plugs & actuators, sensors and switches. Their use and the creation of usage data depend on the control units used. Control units include, for example, Zigbee gateways such as the smik gateway or remote controls with a direct connection without a gateway (Touchlink).
1. What usage data is generated in Zigbee products?
Data is generally only generated when events occur or states change. This depends on the system integration and user behaviour. An exception is the measurement of light levels by sensors, which can take place in real time.
Depending on the type of Zigbee product, different types of product data are generated. When connected to a gateway, this data can be transmitted to the gateway and a remote server. Specifically, the following types of data are involved:
- Lamps & luminaires: network parameters, device configuration, on/off, dimming level, colour temperature, colour, connection status
- Smart plugs & actuators: network parameters, device configuration, on/off, dimming level, connection status
- Switches: network parameters, device configuration, button presses, battery status, connection status
- Sensors: network parameters, device configuration, motion, light level, battery status, connection status
The usage data is not stored in a freely readable file format, but in binary form and in accordance with the Zigbee specification. The storage requirements depend on the respective Zigbee product and its use. As a rule, the storage requirements range from 0.3 kB to 5 kB.
2. How long is usage data stored on Zigbee products?
With the exception of network parameters, the data stored on Zigbee products is only temporary and is overwritten when a new setting or state is recorded. New data is triggered by users via control units or integrated product functions. Neither historical data nor logs are stored on our Zigbee products.
3. How can usage data on Zigbee products be viewed or shared?
Direct access to data stored on Zigbee products is not possible without additional tools. Depending on the connected gateway, certain data is stored by the gateway and can be viewed and shared via it. For the smik gateway, the available options are described in the smik information document and in the smik Terms of Use. 4. How can usage data on Zigbee products be deleted?
The data on Zigbee products can be deleted directly on the device by resetting it to the factory settings. The procedure may vary depending on the product and is explained in the respective instructions.
5. Other information
With regard to Article 3(3) of the EU Data Act and Zigbee products connected to the smik gateway, the following information applies. If the Zigbee products are connected to another gateway with a Zigbee interface, the statements of the respective gateway manufacturer apply.

- A verified user may request the transfer of data to third parties via the following email address: app-support@paulmann.de. The smik Terms of Use apply.
- You have the right to lodge a complaint about an alleged violation of any of the provisions listed here. The competent complaints authority is the “Federal Network Agency”, info@bnetza.de.
- The smik data contains no trade secrets.
- The data licence agreement remains in force in accordance with the Terms of Use until expressly terminated by the user via app-support@paulmann.de. It is not possible to terminate the data licence agreement alone without simultaneously terminating the smik Terms of Use in their entirety.
